Contest Official Rules

1. ELIGIBILITY: THIS IS A CONTEST (A GAME OF SKILL). The Verishot Challenge (“Contest”) is open to all golfers who purchase a round of golf at a participating golf course and has never earned a PGA Professional card. Employees of participating golf courses and their guests are not eligible to participate. This Contest is void where prohibited or restricted by law and subject to all state and federal laws and regulations.

2. SPONSOR: This Contest is sponsored by Nine Iron Innovations, Inc. (“Sponsor”). Sponsor is located at 5755 Granger Rd., Suite 500, Independence, Ohio, 44131.

3. LIMITATIONS: The Contest is only open to participants during course and daylight hours. Prizes will not be awarded except during these hours.

4. HOW TO ENTER: Eligible persons (“Player”) who (i) pay greens fees at participating golf courses (“Golf Course”), (ii) pay for an applicable ticket to participate in the Contest or receive a complimentary ticket (as approved by Sponsor) from the Golf Course to participate in the Contest, and (iii) who agree to be bound by the terms of the Official Rules shall automatically be entered in the Contest. A Player shall receive a ticket (“Ticket”) with a code for validation (“Code”) from the Golf Course. A Ticket may only be used by the Player for the round of golf purchased when the Ticket was issued, inclusive of rain-checks or other weather related delays.
There are three possible winning shots (“Winning Shot”) which may change from course to course. The three Winning Shots are defined as follows:

Hole-in-one
Closest-to-the-Pin (within two feet as measured by the sticker on the flagstick)
Within-the-Flag (within seven feet as measured by the flagstick)

Each Golf Course will have one hole in which the Hole-in-One Monitoring System will be placed (“Eligible Hole”). At the Eligible Hole, there will be a Keypad on the Verishot System (video monitoring pole or mobile unit located behind or adjacent to the green). The Player must tee off and the Winning Shot must be as a result of that initial golf-stroke. More specifically, the Player’s first shot on the hole, from within one of the days' prescribed teeing grounds, must come to rest as a Winning Shot as a result of one stroke. Play of the hole must be within the Rules of Golf as prescribed by the USGA. All male Players must hit their tee shot from behind the appropriate tee markers at the Eligible Hole as placed by the Golf Course. All female Players or seniors must hit their tee shot from behind the red markers at the Eligible Hole as placed by the Golf Course.

5. MINIMUM DISTANCES: A Winning Shot must be hit from a minimum distance as follows unless otherwise approved by Verishot management:

Men – 165 yards
Women and Seniors – 120 yards

6. HOW TO CLAIM A PRIZE: Should the Player claim a Winning Shot, he/she must notify Sponsor by doing the following:

If the Winning Shot is either Closest-to-the-Pin or Within-the-Flag, the Player must measure the shot by laying the flagstick down demonstrating that the Winning Shot meets the criteria.
The Player must enter the Code into the Keypad located on the System. This will send a messaging alert to Sponsor Customer Service to review the claim.
If the Winning Shot is a Hole-in-One, the Player must also call 1-877-270-6660 within five hours of the Winning Shot.

Reporting the event to representatives of the Golf Course only is insufficient. Sponsor will notify the Golf Course, usually within one hour of the acceptance or denial of the Winning Shot claim in the case of a Within-the-Flag or Closest-to-the-Pin Winning Shot. Hole-in-One shots are verified within 48 hours and are paid directly by the Sponsor to the Player, usually within one week after the claim is verified. Sponsor reserves all rights to accept or deny any claim of a Winning Shot and all claim determinations by Sponsor are final. Golf Course may not redeem claimed Prizes without Sponsor approval.

7. PRIZE REDEMPTION: Golf Course may redeem all validated claims by Sponsor on the same day. Prizes are not transferable, assignable or redeemable for cash. All applicable taxes are the sole responsibility of the Player. Players who hit a Hole-in-One will be required to provide Sponsor a W-9 form for tax reporting, an affidavit, and contact information including name, address, and telephone numbers. Failure to provide this information shall disqualify the Player from claim payment. By accepting the Prize and participating in the Contest, Player agrees to release name and video to Sponsor for promotional purposes.

8. GENERAL CONDITIONS AND WAIVER OF LIABILITY: By entering this Contest, each Player agrees to be bound by the terms and conditions of these Contest Official Rules, and the decision of the Sponsor whose decisions are final and not subject to challenge. Sponsor owns all pictures, film and references captured by the System cameras or other devices. Sponsor, Golf Course, and their related, affiliated and subsidiary companies, officers, directors, employees, representatives, agents or independent contractors are not responsible for claims, injuries, losses or damages of any kind resulting from participation in Contest, or acceptance, use, misuse, malfunctioning, possession, loss or misdirection of any Prize. Tickets cannot be transferred, resold or offered for sale. Sponsor, the Golf Course, and their related, affiliated and subsidiary companies, officers, directors, employees, representatives, agents or independent contractors are not responsible for lost, stolen or damaged cards or for ticket errors, printing errors or inaccurate, incomplete, stolen, lost, illegible, mutilated, or misdirected tickets or other entry, or equipment or telephone malfunction.

9. MISCONDUCT: Tee markers may not be moved or adjusted by Players. By entering, Players acknowledge compliance with these Contest Official Rules including all eligibility requirements. Any attempt to deliberately damage the content or operation of this Contest is unlawful and subject to legal action by the Sponsor or its agents. If any equipment or mechanical malfunction, error, disruption or damage occurs, impairing the administration, security, fairness, integrity or proper play of the Contest, Sponsor may, in its sole discretion, suspend or terminate the Contest. Any Player found tampering with, hacking, cheating, or abusing any aspect of the System, or whom the Sponsor believes to be causing malfunction, error, disruption, damage or in an unsportsmanlike manner, attempts to take unfair advantage, will automatically disqualified and prosecuted.
